| This thread is a warning about a web site that has been spamming the forum. The site is called Optimum Health Secrets. Optimum Health Secrets, located at: OptimumHealthSecrets.net is a site that sells miracle juice type scam products and makes fraudulent claims that SCAM customers into thinking they are being treated or cured of diseases etc. Get Discounts, Coupons & Updates from Infinite Sports USAThe owner of OptimumHealthSecrets.net posted multiple threads in our forum claiming that, "ACAI the only help and cure for everything." As anyone knows, it is illegal and unethical to claim that a juice, berry or supplement can cure anything... OptimumHealthSecrets.net claims that this miracle juice junk is a cure for everything. After multiple warnings, we were forced to ban OptimumHealthSecrets as a member on our Health and Fitness Site. If Optimumhealthsecrets posts anything on your blog, health and fitness forum or requests a link exchange, we advise that you do not accept as the claims made are false and unethical. We hope no one is taken for a fool although the claims made were pretty easy to see through. |

| I decided to make sure that these guys aren't posting more spam on other valuable sites, or at least that their spam doesn't stick, so I posted this review and then sent an email to the owner of optimumhealthsecrets (Bobby Nolan). Is this too harsh? Quote:

| Rick, I appreciate you telling me that you have spoken with your employee about spamming other sites and the lack of integrity that involves. I've had employees make mistakes that were bad for business also, so I'll be glad to remove the post. In law, defamation (also called calumny, libel, slander, and vilification) is the communication of a statement that makes a false claim, expressly stated or implied to be factual, that may give an individual, business, product, group, government or nation a negative image. Your employee did, in-fact make claims that were in-fact illegal (Violates FDA Regulations), as well as illegally marketed. SPAM Legislation: http://www.spamlaws.com/state/summary.shtml And we pointed that out to members of our community... FDA Excerpt: : a product sold as a dietary supplement and promoted on its label or in labeling* as a treatment, prevention or cure for a specific disease or condition would be considered an unapproved--and thus illegal--drug. To maintain the product's status as a dietary supplement, the label and labeling must be consistent with the provisions in the Dietary Supplement Health and Education Act (DSHEA) of 1994. *Labeling refers to the label as well as accompanying material that is used by a manufacturer to promote and market a specific product. I'll remove the posts but we both know you're not going to file an unjustified slander suit where your company is also in danger of FDA Debarment. Thanks for your support. |

You'd think your Legal associate knew which business you owned, right? How does this guy get off posting spam (Against our forum's rules) then saying he's going to sue me for pointing out that he's making false claims about curing diseases? What do you guys think? Should we just ignore it and let people ruin this forum by filling it with useless (illegal) junk? |

| Rick, You or your employee intentionally made a decision to break the rules of our forum and post information that was useless to our members except to tick them off and fill the site with your (illegal) advertisements and claims. Does your product cure diabetes or cancer because if it does, both me and my grandfather need a case of it. We work very hard to maintain a community of quality content and useful information. Your company posted spam advertisements (in violation of our forum rules) and didn't even take the time to post them in an area that was appropriate to their content. As I said before, I will remove the post, but I am asking that you and/ or your employees do not post spam that I am forced to moderate. Thanks. - Curtis Sent via BlackBerry from T-Mobile |
